The right to reproduce is subject to a concession which can be granted by previous assurance of the existing of the prescribed requisitions, and against payment of the tariffs fixed by the Municipal Administration, any eventual royalties excluded. In accordance with a dual aim ofpublic use and preservation of the Forteguerriana Library’s collection, the right to reproduce can be limited by the necessity to protect and to preserve the property and the copy required. The right to reproduce is also limited by the laws in force to protect the royalties, and by any other juridical bonds to which the required copy is submitted.

The requests for reproduction have to be addressed by the applicant to the person responsible of the documentary collection by means of specially prepared application forms. On requiring the applicant has to specify the means, modality and place of execution of the reproductions,the quantity intented to obtain and to put on the market, and also the way ofdistribution. In case of authorization to reproduce by the applicant, it’s up to the applicant himself to arrange to meet the assigned staff and the photographer, and to demand for that time the availability of the work or of the document. The applicant bounds himself to pay in advance the tariffs and/or the reimbursement of the expenses fixed by the Administration. Every reproduced copy shall bear the details of the original work and its location, according to the correct procedure. Moreover, it shall bear the mention “By license of..” and also the express warning ofprohibition to reproduce further on.

The person responsible of the collection may ask to deposit a copy of all (or a selection of) the photographic reproductions in original negative and in positive format 18x24, and of the authorized shots executed by the applicant. It is compulsory to deposit a duplicate of every slide.

Authorizations are granted by the person responsible of the documentary collection of which the materials to be reproduced are a part of. The Manager, or the Managers, appointed as responsible ofthe Forteguerriana Library’s property may exclude, through special justified acts, some books, documents, works, particular funds from reproducing, or from using particular reproduction techniques,which may damage them considering the physical form or the condition of the material itself. Agreements with the person responsible of the documentary collection excepted,followed by a justified explicit authorization by the Manager, it is forbidden to reproduce works in the course of restoring, or for two years after restoration, or the new acquistitions. As a rule it is not allowed to detach, remove or release the works from glasses or frames.

In case of reproductions required for a stricly personal use or for study, the applicant has to subscribe an engagement of no divulging. The reproduction for a strictly personal use or for study is only subject to reimburse the expenses met by the Administration.

Reproductions and shots executed by Organs and Institutions whose insitutional purpose is the research are only subject to reimburse the expenses, where owed, if their publication hasa strictly scientific technical nature.

Reproductions and shots executed for a commentary purpose, therefore strictly connected to facts, events, particular happenings, are free. As a rule the publication of supplements, inserts, other enclosures or special reports, is not considered for commentary purpose.

If reproductions are used both for printed than electronic publications, it is compulsory to require a preventive explicit authorization and to pay the owed tariff. Moreover, it is compulsory to deliver the publication in duplicate to the person responsible of the collection.

The photographer and/or the operator give up their royalties on picture when executed, remaining the Municipal Administration the only owner of the picture of reproduced documents and works.

For what is about the photographic material in possession ofthe Administration which are not of its property, the provisions of the following table of charges are applied, upon agreement with the owner. The Manager is allowed to estimate, from time to time, the request and to take a decision for the Administration interest if the aims of the applicant are in coherence with the ones of the Municipal Administration, and, anyway, for other requirements with a particular purpose, commerce excluded.

The above mentioned reimbursements refer to negatives of the required reproductions disposal with the Administration. The rights of publication are excluded. To reproduce a picture in a printed or electronic edition in language, an additional amount equal to three times the price of the print is owed.

The rights of reproduction are excluded in the above mentioned tariffs, which are charged to the applicant. The tariff gives the right of publication of only one picture, in only one edition and in only one language, and gives the right to shoot each subjet for ten clicks maximum. For any following reproduction and publication the tariff has to be paid again. Reimbursements: 10% of tariffs.

Reprinting by the same publisher: 50% reduction on tariffs for rights of reproduction. World-wide rights: three times the tariffs. Using again the same matrix: by the same publisher for another work: 50% reduction on the rights of reproduction; by another publisher: 25% reduction.
